This new right, effective from January 1, 2026, allows farmer parents to take leave after maternity, paternity, or adoption, or even without having taken these leaves beforehand. Each parent can benefit individually, simultaneously, or alternately, provided they cease their activity and are replaced by an approved Replacement Service.
The scheme targets several categories of non-salaried agricultural workers, including farm or agricultural business managers, non-salaried members of agricultural companies (GAEC, EARL), family helpers, farm partners, and farm collaborators, including the mother's spouse, PACS partner, or cohabiting partner.
To benefit, individuals must consistently participate in farm work, be affiliated with Amexa for at least 6 months, cease all work during the leave, and be replaced by a Replacement Service contracted with the MSA. The leave, with a maximum duration of two months, can be split and must be taken within 9 months of the child's birth or arrival in the household.
The application for replacement allowance is submitted to the MSA, via a Cerfa form or online through MesDémarchesSimplifiées. Application deadlines vary depending on whether the leave is taken concurrently with other leaves (maternity, paternity, adoption) or separately, but must respect a notice period of at least 20 days before the interruption of activity.
